The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 341/323/406/504/ and 506/34 of the Indian Penal Code as well as Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Learned counsel for the petitioners submits that an out and out false and fabricated case has been made against these petitioners making allegations of having dues of Rs. 1,53,000/- out of which Rs. 26,000/- was paid to the informant. He further submits that so far as allegation made out by the informant under the provisions of Scheduled Castes and Scheduled Tribes
Patna High Court Cr.Misc. No.19225 of 2015 (4) dt.22-09-2015 P2/2 (Prevention of Atrocities) Act, 1989 are concerned, they are wholly misconceived as admittedly, the occurrence alleged to have taken place at the house of the informant not at a public place. Considering the aforementioned facts and circumstances and also that under similar circumstances in connection with the same case one Abhimanyu Singh has been extended the privilege of anticipatory bail in Cr. Misc. No. 19338 of 2015 vide order dated 29.04.2015, let the petitioners, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Banka in connection with S.C./S.T. P.S. Case No. 1/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
