This is an application for bail in connection with Jagdishpur P.S.Case No. 105 of 2016 registered for the offences punishable under Sections 341, 447, 323, 307 and 504/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that petitioner has committed no offence and has falsely been implicated in this case and dispute arose with regard to a mango tree and there is marpit between the parties and the petitioner has no intention to assault anyone and the injuries found on the person of the injured are simple in nature, except one, which is grievous and the petitioner is in custody for four months. Heard learned APP also, who has opposed the prayer
Patna High Court Cr.Misc. No.6166 of 2017 (3) dt.28-02-2017 2/2 for bail stating that there is direct allegation against the petitioner causing grievous injures on the person of the injured. Having heard both sides and considering the fact that there is direct allegation against the petitioner, I am not inclined to grant bail to the petitioner.
The petitioner may renew his prayer for bail before the court below after framing of charge in this case. With the above observation, this application is dismissed.
