Petitioner seeks bail in Tariyani P.S. Case No.20 of 2019 instituted for the offence under Section(s) 392, 411 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. No incriminating article has been recovered from his possession. In the written report, it is alleged that two miscreants entered into the service center of IDFC Bank and on the point of pistol and knife took away money, mobile phone of OPPO and Tablet. Petitioner is not named in the First Information Report. No Test Identification Parade has been held.

As per seizure list, there is recovery of one OPPO

Petitioner is in custody since 03.02.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar, in connection with Tariyani P.S. Case No.20 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
