JUSTICE SUDHIR SINGH ORAL ORDER 25-06-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Madhwapur P.S.Case No. 69 of 2012 instituted under Sections 304(B)/34 of the Indian Penal Code. The prosecution story, in brief, is that the informant Bharat Singh had married his daughter Shobha Devi with coaccused Rajib Kumar Singh about three years ago. After marriage the husband of his daughter and other in-laws were demanding motor cycle, T.V., Golden chain etc. and they were assaulting his daughter. The informant tried to pacify the matter and lastly he brought his daughter to his own house. About fifteen days ago
Patna High Court Cr.Misc. No.20443 of 2015 (2) dt.25-06-2015 2/3 from the date of occurrence, they took her to her matrimonial house. On 30.10.2012. the informant had come to know that his daughter has been killed and dead body has been thrown out side the house. Then the informant and others came there and saw that all the accused persons including the petitioners have committed murder of his daughter.
It has been submitted on behalf of the petitioners that the petitioners have no criminal antecedent and for last twenty one years they have nothing to do with the husband of the deceased. It is further submitted that petitioner no.1 is the Chachari Sas and petitioner nos. 2 and 3 are Chacheri Nands and studying at Sitamarhi and Patna respectively and petitioner no.4 is the Chachera Debar and residing at Varanasi.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhubani in connection with Madhwapur P.S.Case No. 69 of 2012, subject to the conditions as
