JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-09-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and learned A.C. to AAG-6.

The learned counsel for the petitioner submits that the entire grievances of the petitioner has stood redressed except for payment of leave encashment amount for the balance period of 89 days.

The learned counsel for the respondents has submitted

Patna High Court CWJC No.8721 of 2018(7) dt.16-09-2020 2/2 that the balance payment for the remaining 89 days has also been sanctioned, as is apparent from paragraph no. 11 of the counter affidavit filed on behalf of the respondent no. 5. I have heard the learned counsel for the parties and perused the materials on record and I find that the balance amount of leave encashment for a period of 89 days has already been processed, hence this Court deems it fit and proper to dispose off the present writ petition with a direction to the respondent authorities to pay the balance amount of leave encashment for 89 days, if not already paid, within a period of six weeks from today, failing which the Principal Secretary, Rural Works Department, Government of Bihar, Patna, shall not draw his salary.

The Registry of this Court is directed to transmit a copy of this order to the Principal Secretary, Rural Works Department, Government of Bihar, Patna forthwith. (Mohit Kumar Shah, J) S.Sb/- U
