2. The petitioner apprehends his arrest in Bajpatti PS Case No. 15 of 2022 registered for the offences punishable under Section 304(B)/34 of the Indian Penal Code.

3. As per the prosecution case, daughter of the informant was married with this petitioner six years ago. After marriage, informant's daughter was subjected to mental and physical torture for dowry by the accused persons including petitioner. Ultimately, on 25.01.2022, this petitioner along with co-accused committed murder of the daughter of informant due to non-fulfillment of demand of dowry and threw her dead body in a pond. The deceased has got three minor chidren.

4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence. Informant

Patna High Court CR. MISC. No.41290 of 2023(3) dt.29-08-2023 2/2 is not eye-witness of the occurrence. In fact, deceased died due to drowning in pond. The deceased and petitioner had cordial relation and there was no difference at all. There is general and omnibus allegation and entire allegation is false and fabricated. Petitioner has got no criminal antecedent.

5. Learned APP however, vehemently opposed the prayer for bail.

6. Considering the facts aforesaid and the nature of allegation and the fact that petitioner is husband of the deceased and deceased died in unnatural circumstance within seven years of marriage at her matrimonial home, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
