JUSTICE SANJAY PRIYA ORAL ORDER 3/ 25-07-2019 Heard learned counsel for the petitioners and learned APP for the State as well as counsel for the informant. Petitioners seek bail in Begusarai Muffasil (Lakho) OP Case No.77 of 2019 instituted for the offence under Section(s) 302, 201, 120-B, 504, 506/34 Indian Penal Code. In the written report, it is alleged that son of the informant, Mithun Ram, had gone to Mohalla- Chankaya Nagar for livelihood. The co-villagers of the informant, namely, Mallu Ram, Bipin Ram and Sandip Ram, all sons of Suresh Ram, went to the house of the informant and enquired about his son. The informant disclosed that he has gone to Chanakya Nagar. Thereafter, all the persons left the place. Son of the informant

The informant went to the place of work of his son where he came to know that all the three persons have called his son. Thereafter, he went to the house of Suresh Ram to know about his son. At that time, Bhutta Ram came out of the house and told that his son has got punishment. Other two sons of the informant have also abused the informant. Son of the informant did not come till night. In the morning, the informant came to know that one dead body is lying in Dhorha Chaur. He has been killed by cutting neck and by shot of firearm. The informant has raised suspicion that petitioners have killed son of the informant under conspiracy.

Counsel for the informant has submitted that in para 39 it has come that deceased was having illicit relationship with daughter-in-law of Suresh Ram. There was strong motive to commit murder.

Counsel for the petitioners submits that only suspicion has been raised against the petitioners.

Petitioners are in custody since 13.02.2019.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like
