The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307/34 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that the accused persons including the petitioners variously armed surrounded the informant and when the informant tried to escape then co-accused Raj Deep Yadav fired, causing injury on the left lower abdomen and thereafter co-accused Binodi Yadav and Mukesh Yadav fired. It is also alleged that while informant was being treated then Pramod Yadav reached to the hospital and attempted to fire on the informant. It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.19347 of 2015 (2) dt.29-04-2015 petitioner that the accusation of firing is not against the petitioner and for the occurrence of 14.11.2013 the First Information Report was registered on 25.11.2013. Considering the delayed lodging of the case and accusation of firing against First Information Report named accused, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Rosera, Samastipur in connection with Bithan P.S. Case No. 132 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
