The petitioner seeks bail in Udwant Nagar P.S. Case No. 452 of 2020, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.
As per the FIR, petitioner along with co-accused Prakash Chaudhary came at the house of informant and threatened his aunt and pressurized her to compromise and also not to depose in the case which was instituted against Dipu Chaudhary and thereafter, fired upon the informant and his aunt, but nobody was hurt.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Co-accused Prakash Chaudhary has already been granted bail by a
Patna High Court CR. MISC. No.49499 of 2021(3) dt.13-01-2022 2/2 coordinate Bench of this court vide order dated 05.01.2022 passed in Cr. Misc. No. 35868 of 2021. Petitioner is in custody since 02.01.2021.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant Nagar P.S. Case No. 452 of 2020.
