2. The petitioners are apprehending their arrest in connection with Rajnagar P.S. Case No. 471 of 2024 dated 10.12.2024 corresponding to G.R. No. 2837/2024 for the offences punishable under Sections 189(2), 126(2), 115(2), 109(1), 118(1), 117(2), 303(2), 352, 351(2) read with Section 3(5) of the B.N.S.
3. As per prosecution case, when the informant along with his friend Md. Asraf was coming from Gaurimeran after attending his friend's Haldi ceremony and when they reached at Rajnagar Gumti, all the accused persons including the
Patna High Court CR. MISC. No.37474 of 2025(2) dt.02-07-2025 2/3 petitioners started to assault him and made him injured. When his friend came to rescue, they also assaulted him with slaps. Md. Amanulla @ Chand and Md. Sarfaraj came to rescue him then the accused persons including the petitioners assaulted them with knife and dagger due to which they got seriously injured. The accused persons also took gold bracelet and Rs. 1300/- in cash.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The occurrence took place on 04.12.2024 but the F.I.R. was lodged on 10.12.2024 and there is no explanation for this delay. There is no specific allegation against the petitioners rather the allegation against the petitioners is general and omnibus. Nothing has been recovered from the conscious possession of the petitioners. As per the injury report of the injured, the injuries are simple in nature caused by hard and blunt object. The petitioners have no concern with the alleged offence. The petitioner no. 1 has no criminal antecedent whereas the petitioner no. 2 has two criminal antecedents as stated in para 3 of the bail petition.
5. Learned APP for the State has vehemently opposed the prayer for anticipatory bail of the petitioners.

Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioners, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned court concerned, Madhubani in connection with Rajnagar P.S. Case No. 471 of 2024, subject to conditions as laid down under Section 482(2) of the B.N.S.S.
7. The application stands allowed.
