JUSTICE ANIL KUMAR SINHA ORAL ORDER 11-05-2023 Heard learned counsel for the parties concerned. Petitioner has filed the present writ application for a direction to the respondents particularly respondent No. 5 i.e. District Programme Officer, Establishment (Education), Siwan, on compassionate ground on the post of Clerk/Peon or any other appropriate post. The father of the petitioner died in harness while working as a teacher in High School, Gahilapur, on 10.01.2017.

A counter affidavit has been filed by the respondent No. 5 i.e. District Programme Officer Establishment (Education), Siwan, stating therein that the provisional merit list

Patna High Court CWJC No.10649 of 2022(4) dt.11-05-2023 2/2 of dependents of deceased teacher/non teaching employees has been prepared by the Zila Parishad, Siwan and the petitioner's name is figured at Sl. No. 23 of the provisional list. It has further been stated that the candidates upto Sl. No. 14 of the provisional list has been appointed in the fixed pay of Rs.16,500/- per month on the post of School Assistant. The case of the petitioner for appointment on compassionate ground on Group-D post shall be considered in the future vacancy in terms of the provisional merit list.

Having heard learned counsel for the parties and taking into consideration the statement of the respondents made in the counter affidavit, the present writ application is disposed with a direction to the concerned respondents to consider the case of the petitioner from the provisional merit list as and when his turn comes.
