The petitioners apprehend their arrest in a case registered for the offence under Section 307, 379 & other allied sections of the Indian Penal Code.

As per the F.I.R., when petitioner no. 1 tried to outrage modesty of the informant, she raised alarm, upon which, other F.I.R. named co-accused persons assembled and assaulted the informant and her family members.

It is submitted on behalf of petitioners that injuries sustained by the informant side have been found to be simple in nature. Present case is counter blast of Bihiya P.S. Case No. 165 of 2021 lodged by petitioner no. 1 against husband of the informant, in which, petitioners have also sustained injury.

No.49304 of 2021(2) dt.21-06-2022 2/2 Though, in the F.I.R., these two petitioners have assaulted the informant and others, but the injuries have been found to be simple in nature. Petitioners claim clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as nature of accusation, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Bhojpur, Ara in connection with Bihiya P.S. Case No. 166 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
