JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Nayaramnagar P.S. Case No.110 of 2016 registered for the offences under Sections 25(1)a, 25(1-AA), 25(1-AC), 25(1-B)A, 25(1-B)C, 26(i)(ii) and 35 of the Arms Act.

Accusation is that on receipt of secret information about running of a factory of illegal mini gun at Barra Hill, the police party reached there. On seeing the police party several persons started fleeing away but ten persons including the petitioners were apprehended on hill in plastic shade from where semi prepared country made pistol, 10 magazines, 12 semi prepared pistols, other instruments used for preparing gun and also other materials using in preparing the gun were seized.

Patna High Court Cr.Misc. No.9757 of 2017 (2) dt.16-03-2017 2/2 Submission is that the petitioner is in custody since 04.08.2016. Further submission is that similarly situated coaccused Balkaran Bind has already been enlarged on bail vide order dated 11.01.2017 passed in Cr.Misc.No.613/17 by coordinate Bench.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M.-1st , Munger, in Nayaramnagar P.S. Case No.110/16.
