The petitioner seeks bail in Amarpur P.S. Case No. 386/2016, registered for the offences punishable under Sections 25(a)(AA)(1-b)a, 26(i),(ii),(iii), 28 and 35 of the Arms Act. The police apprehended five persons and alleged that they all were manufacturing arms.

Learned counsel for the petitioner submits that the place of seizure is a lonely place. The petitioner has falsely been implicated in the case. Nothing has been recovered from conscious possession of the petitioner. Similarly situated co-accused persons namely, Manoj Sharma, Rahul Kumar @ Sonu Kumar, Pankaj Kumar Choudhary and Aankaj Kumar @ Aankaj Kumar Choudhary @ Aankaj Choudhary have already been enlarged on

Patna High Court Cr.Misc. No.15796 of 2017 (2) dt.25-04-2017 bail vide order passed in Cr. Misc. 15217/2017 and 1991/2017. Considering the facts aforesaid and the fact that the petitioner is in jail since 10.09.2016 and he has got no criminal antecedent, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 386/2016.
