The petitioners apprehend their arrest in connection with Sugauli P.S. Case No. 23 of 2020 registered under Sections 147, 148, 149, 341, 342, 323, 324, 307, 332, 333, 188, 427, 353, 504, 506 and 120(B) of the Indian Penal Code and Section 3⁄4 of Prevention of Damage to Public Property Act, 1984. Learned counsel appearing on behalf of the petitioners submits that similarly situated co-accused persons have already been allowed bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 34669 of 2020 on 05.07.2021, as contained in

Patna High Court CR. MISC. No.49392 of 2021(2) dt.25-03-2022 2/3 Annexure-2 to the bail petition.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari in connection with Sugauli P.S. Case No. 23 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C. and further:- (i) that one of the bailors shall be a close relative of the petitioners.

(ii) that the petitioners and the bailors shall execute bond and give undertaking with regard to good behaviour of the petitioners.

(iii) that the petitioners shall cooperate with the Court and police/prosecution.

Any violation of the terms and conditions of the bonds or the undertaking or non-cooperation shall lead to cancellation of their bail bonds.

It shall also be open for the prosecution to bring any violation of the foregoing conditions of bail by the petitioners,

Patna High Court CR. MISC. No.49392 of 2021(2) dt.25-03-2022 3/3 to the notice of the Court concerned, which shall take immediate action on the same after giving opportunity of hearing to the petitioners.

The petition stands disposed off in the aforementioned terms.
