The petitioner seeks bail in Jamalpur P.S. case No. 68 of 2009, corresponding to Sessions Trial No. 676 of 2014, under Section 399, 402, 414 of the Indian Penal Code, under Section 25(1-b) A, 26/35 of the Arms Act and under Section 3⁄4 of Explosive Substance Act.

The informant, S.H.O. of Jamalpur P.S., alleged that he got information that petitioner, who is a dreaded criminal, had assembled near a place along with other accused persons. The informant and other police officers went there but the petitioner and Manoj Singh managed to flee away. One Sonu Kumar was apprehended and from his possession arms and ammunition were recovered.

Patna High Court Cr.Misc. No.14905 of 2017 (2) dt.20-04-2017 2/2 The learned counsel for the petitioner submits that petitioner was not apprehended on the spot. Nothing has been recovered from the possession of the petitioner. The petitioner, of course, has got criminal antecedent but he is in jail since 21.04.2015.

Considering the facts aforesaid and the fact that petitioner has remained in jail in this case for two years, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Munger in Jamalpur P.S. Case No. 68 of 2009, corresponding to Sessions Trial No. 676 of 2014, subject to condition that one of the bailors shall be close relation of the petitioner.
