The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, on a raid being conducted, a total of 945 litres of liquor was recovered from the parti land of co-accused Vikram Singh and from the vehicle in question.
It is submitted by learned counsel for the petitioner that from perusal of the F.I.R., it would transpire that the name of the petitioner transpired in the statement of co-accused Vikram Singh made before police. No incriminating article has been recovered from the petitioner's possession who is in custody since 13.7.2021 and chargesheet has been submitted in
Patna High Court CR. MISC. No.49809 of 2021(2) dt.22-02-2022 2/2 the case.
Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having been arrested at the spot and having remained in custody for more than 7 months, the Court directs the petitioner to be enlarged on bail in connection with Jamhore P.S. Case no.67 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II-cumSpecial Judge, Aurangabad.
