The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No 468 of 2011 arising out of Parasbigha PS Case No 84 of 2005 dated 30.08.2005 registered for the offence punishable under Sections 147, 148, 149, 302 of the IPC, Section 27 of the Arms Act and Section 17 of the CLA Act.

As per the prosecution case, some unknown miscreants killed the father-in-law and the brother-in-law of the informant.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.42984 of 2023(2) dt.21-07-2023 2/2 case. The petitioner bears one criminal antecedent, as stated in paragraph 3 of the bail petition in which he is on bail. It is further submitted that there is general and omnibus allegation against the petitioner. The co-accused Shri Sharma @ Shri Niwas Sharma has already been granted bail vide order dated 16.12.2008 passed in Cr Misc No 46940 of 2008. The petitioner is in custody in this case since 27.03.2019.

Learned APP has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I, Jehanabad in Parasbigha PS Case No 84 of 2005 dated 30.08.2005.

This application stands allowed.
