JUSTICE SANJAY PRIYA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rajauli P.S. Case No. 208 of 2016 instituted for the offence under Sections 47(a) and 57 of the Bihar Excise (Amendment) Act, 2016.
It is alleged that 192 bottles of 750 ml. Royal Stag wine were recovered from the Honda City vehicle. It is further alleged that petitioner started running away from the vehicle and was arrested.
From the impugned order it appears that charge has already been framed in this case. It is mentioned in paragraph-3 that the petitioner has no criminal antecedent. He is in custody since 26.8.2016.
In such circumstances, prayer for bail of the petitioner
Patna High Court Cr.Misc. No.11102 of 2017 (3) dt.12-04-2017 2/2 is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sesions Judge-II, Nawada, in connection with Sessions Trial No. 72 of 2017/03 of 2017 arising out of Rajauli P.S.
