The petitioner apprehends his arrest in connection with East Champaran P.S Case No. 574 of 2014 arising out of G.R. No. 4205 of 2014 registered for the offence punishable under Section 366-A/34 of the Indian Penal Code.
On behalf of the petitioner it is submitted that in this case so-called victim girl has married to Md. Taj and out of the wedlock one child was born but thereafter, the informant has filed this case. Other co-accused person has been granted bail vide Criminal Miscellaneous No. 10815 of 2016 and further Md. Taz has also been allowed anticipatory bail vide Criminal
Patna High Court Cr.Misc. No.13051 of 2017 (3) dt.27-03-2017 Miscellaneous No. 8524 of 2017 by another co-ordinate Bench of this Court and, as such, the petitioner also deserves sympathetic consideration.
Learned A.P.P. fairly submits that other co-accused persons have been allowed pre-arrest bail.
In the facts and circumstances stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of the order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran, Motihari in connection with East Champaran P.S. Case No. 574 of 2014 arising out of G.R. No. 4205 of 2014 subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
