The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 365/34 of the Indian Penal Code.
Allegation is that informant Sonia Devi alleged that the son Anil Kumar aged about 25 years was working as cleaner at on the Truck bearing registration no. JH02H3033 which was owned by the petitioner. On 02.02.2019 he had gone to Patna with the driver Pintu Chandrawanshi and which was in the knowledge of the owner. Her son yet not returned. When the informant asked the driver Pintu, he replied that his son would never come as he was kidnapped.
Learned counsel for the petitioner submits that there is
Patna High Court CR. MISC. No. 35844 of 2019(4) dt.13-08-2019 2/2 no specific allegation against the petitioner and the allegation is general and omnibus. The petitioner is 70 years old and has no criminal history. The allegation is against the driver Pintu only. In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rohtas P.S. Case No. 29 of 2019 to the satisfaction of the learned S.D.J.M., Dehri (Rohtas), subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
