The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code. As per the prosecution case, this petitioner along with eight other FIR named accused persons assaulted the brother of the informant by means of rod, khanti, etc. as as result of which he died.

Learned counsel for the petitioner submits that the present case is the counter blast of Mufassil Police Station Case No. 652 of 2020 in which this petitioner is the informant. In the said occurrence, brother of the informant Dhero Singh

Patna High Court CR. MISC. No.49762 of 2021(3) dt.13-01-2022 2/2 came to the petitioner's house and killed his wife. He had been caught on the spot and was handed over to the police with pistol. There is general and omnibus allegation of assault. Petitioner has claimed clean antecedent and he is in custody since 23.12.2020.

Learned counsel appearing for the State and the informant oppose the prayer for bail. They submit that petitioner is also alleged to be one of the assailants of the deceased as seven injuries had been found to be on the body of the deceased.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Begusarai Mufassil Police Station Case No. 653 of 2020.
