====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 28-07-2023 Heard Mr. Abhimanyu Deo, learned counsel appearing on behalf of the petitioner and Mr. Dinesh Singh, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Alamganj P.S. Case No. 624 of 2021, registered under Section 30(a), 37(c) and 41(1) of the Bihar Prohibition and Excise Act.

3. The allegation is of recovery of 300 litres country made liquor from the house of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is not involved in the alleged manufacturing or sell of country made liquor, which has been recovered from her house, rather, the other persons of the house is involved in such trade. The petitioner has clean antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. Having heard both the sides and the material available on the record as well as considering the facts and circumstances of the case and the nature of allegation made against the petitioner as well as the fact that the petitioner was not present at the time of the alleged recovery of 300 litres of country made liquor, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna City in connection with Alamganj P.S. Case No. 624 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
