The petitioner is accused in connection with Sessions Trial No. 148 of 2014 arising out of Majorganj P.S. Case No. 133 of 2012 registered under sections 304B, 328, 201/34 of the I.P.C. pending in the Court of Sessions Judge, Sitamarhi. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is also submitted that petitioner has no criminal antecedent and is in custody since 24.06.2013.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is specific allegation against the petitioner, who happens to be
Patna High Court Cr.Misc. No.17492 of 2017 (3) dt.17-07-2017 2/2 husband of the deceased, had given poison to the deceased along with other accused persons and witnesses have also supported the allegation.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, Trial Court is directed to expedite the trial within a period of three months.
