JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-02-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in Excise Case No.146/2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is no recovery from the conscious possession of the petitioner. It is further submitted that the petitioner was not apprehended at the spot. The petitioner has no manner of concern with the recovered liquor. It is lastly submitted that the petitioner has got no criminal antecedent as stated in para 3 of the bail application.

Patna High Court CR. MISC. No.48799 of 2021(2) dt.04-02-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that 12.960 litres of foreign liquor has been recovered from the hut of the petitioner.

Taking into consideration the fact that 12.960 litres of foreign liquor has been recovered from the hut of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
