JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Town (Hajipur) P.S. Case No. 503 of 2014 registered for the offences punishable under Sections 147, 341, 307, 323, 504 & 506 of the Indian Penal Code.

Allegedly, the petitioners and 15-20 unknown members of Bhartiya Communist Party (Malley) assaulted the guard of the informant and further they caused hindrance in performing official duty and further they caused threats to kill. Submission is that there is no specific allegation against the petitioner and the allegations are omnibus and general in nature, no offence is made out, as a matter of fact the informant

Patna High Court Cr.Misc. No.42303 of 2014 (2) dt.04-03-2015 and other staffs of the hospital were demanding rangdari for delivery of a poor woman in which the petitioner intervened and on account of this the informant filed this false case to which the learned APP opposes.

Considering that there is no specific allegation against the petitioner, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Town Hajipur P.S. Case No. 503 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
