JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Agaion (Garhani) P.S. Case No. 41/09 registered under Section 306/34 of the Indian Penal Code.

Allegedly, the daughter of the informant was found dead lying at the passenger Cell of Garhani Station and it is alleged that co-accused persons used to torture his daughter and as such on account of her frustration, she may have committed suicide and at the time of death she was having convulsions.

No.42353 of 2014 (2) dt.04-03-2015 2 / 2 It is submitted on behalf of petitioner that in this case father-in-law and brother-in-law have already been allowed prearrest bail vide Cr. Misc. No. 5133 of 2010 by order dated 30.03.2010 and the petitioner being also one of the brother-in-law deserves sympathetic consideration to which the learned A.P.P opposes the prayer of pre-arrest bail.

In the circumstances, the above-named, petitioner in case of arrest or surrender within two months from receipt of the copy of the order or production of the same shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Agiaon (Garhani) P.S. Case No. 41/2009, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
