JUSTICE SATYAVRAT VERMA ORAL ORDER 27-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Kudhani P.S. Case No. 19 of 2018 instituted for the offences under Sections 392/34 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 30.06.2021, charge-sheet has been submitted and petitioner has antecedent of six cases. Allegation is of looting the tractor and Rs.10,000/- of the informant on point of gun by two unknown miscreants. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.49022 of 2021(2) dt.27-01-2022 2/3 FIR was against unknown and name of this petitioner transpired in the confessional statement of co-accused Dinesh Chaudhary. The petitioner has not been put on T.I. Parade nor any incriminating article was recovered from his possession and coaccused, namely, Maksud Mansuri @ Maksood has been granted bail by order dated 12.01.2022 in Cr. Misc. No. 46999 of 2021.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted and co-accused has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Kudhani P.S. Case No. 19 of 2018, with condition that one of the bailors shall be the father of the petitioner, namely, Rajnath Singh @ Raju Singh and further that the petitioner in between 25th to 30th of every month commencing from February, 2022 will keep marking his attendance in the concerned police station till framing of the charges and, in the event, it is reported by the concerned police
