JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 02-12-2016 Heard learned counsel for the petitioner, the State and the Danapur Nizamat Municipality.

The petitioner claims that private respondents have not only encroached the Municipal land of survey plot no. 1345 of Danapur Nizamat Municipality but have also blocked the Nala by constructing permanent structure over 240 sq. feet. It is contended that a complaint was made to the respondent no. 4 on 26.4.2014 itself vide Annexure 1 but no action has been taken as yet. Accordingly, this writ application is being disposed of

Patna High Court CWJC No.18440 of 2014 dt.02-12-2016 2/2 with a direction to the respondent no. 4 to take a decision and bring the concerned matter to its logical conclusion within a period of three months from the date of receipt / production of a copy of this order after granting reasonable opportunity to all the concerned including the private respondents.

However, it is made clear that this Court has not formed / expressed any opinion with respect to the merit of the case of the petitioner.
