The petitioner apprehends his arrest in Akbarpur P.S. Case No. 16 of 2013 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. It is submitted that prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 31.03.2014 passed in Cr. Misc. No. 27296 of 2013. It is submitted that subsequently Kanchan Devi wife of Sikendra Yadav was granted anticipatory bail vide order passed in Cr. Misc. No. 26592 of 2014. Later on Sikendra Yadav has also been granted anticipatory bail. It is further submitted that allegation against the petitioner is that the petitioner along with others took the deceased on the pretext of marriage, but later on the dead body of the deceased was found. Patna High Court Cr.Misc. No.20836 of 2015 (3) dt.19-07-2016 2/2 has stated that it was the petitioner Sunil Yadav who killed Kishore Yadav. The case of Kanchan Devi and Sikendar Yadav is quite different.
Considering the facts aforesaid, I am not persuaded to take different view. Accordingly, the anticipatory bail of the above named petitioner is rejected.
