JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 3964 of 2019, arising out of Danapur P.S. Case No. 300 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.
Prosecution case is that seeing the police party one person on Apache motorcycle tried to flee away along with a bag police tried to catch hold of him but he succeeded in fleeing away and later on 5 bottles of foreign liquor each containing 750 ML and 10 bottles of liquor each containing 750 ML were recovered from the motorcycle and on secret information police got the name of the petitioner, who succeeded in fleeing away. Submission of learned counsel for the petitioner is that there is nothing to connect the petitioner in this case and

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna, in connection with Special Case No. 3964 of 2019, arising out of Danapur P.S. Case No. 300 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
