The petitioners apprehend their arrest in Sadar P.S. Case No. 319 of 2006 instituted for the offence under Section (s) 420, 467, 468, 471, 120B of the Indian Penal Code. As per written report, a compromise was made in the Lok Adalat with regard to Title Suit No. 254 of 1992 pending in the Court of learned Sub-Judge, Muzaffarpur. After compromise, all the accused persons got possession as per decree of compromise and got rent receipt. It is alleged that on 10.11.2006 and 21.11.2006, one Santosh Kumar, in conspiracy with petitioners and others, executed the sale deed in favour of

Patna High Court Cr.Misc. No.13987 of 2017 (2) dt.27-03-2017 2/2 petitioner No. 1 which was illegal.

It has been submitted on behalf of the petitioners that from the written report itself, it appears that the disputed land is in possession of the informant. In this manner, it is a matter of civil dispute and civil remedy is available to the informant.

In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, above named, within six weeks from today in connection with Sadar P.S. Case No. 319 of 2006, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
