16-06-2015 Heard Sri Hemendra Prasad Singh, learned senior counsel, who was assisted by Sri Arbind Kumar, learned counsel for the petitioner and Sri Tarun Prasad Mandal, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Katihari Town P.S. Case No. 160 of 2015 registered for the offence under Sections 406, 420 and 467 of the Indian Penal Code, has prayed for grant of anticipatory bail.

Learned senior counsel for the petitioner submits that on perusal of F.I.R. itself, it appears that nature of accusation was completely civil in nature, however; colour of criminal offence has been given. He further submits that entire amount has already been deposited, but some delay has occurred and even then,

Patna High Court Cr.Misc. No.19045 of 2015 (2) dt.16-06-2015 2/2 F.I.R. has been lodged.

In view of the facts and circumstances, let the petitioner namely Birendra Kumar Singh be enlarged on bail in the event of his arrest or surrender before the court below within a period of one month from today on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 160 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay/- U T
