The petitioner seeks bail in a case registered under Sections 279, 337, 338 of the Indian Penal Code and Sections 25(1-B)a/35 of the Arms Act and Sections 37(c), 30(a) of Bihar Prohibition and Excise Act, 2016.
Allegation is that 50 ml wine is recovered from the vehicle.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.3.2019 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. The petitioner is said to be in drunken state.
Patna High Court CR. MISC. No.35640 of 2019(3) dt.15-07-2019 2/2 Other co-accused has been granted bail vide Cr.Misc.No.39648 of 2019.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge II-cum-Special Judge (Excise), Lakhisarai in connection with Barahiya P.S. case No.63 of 2019.
