2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 406 and 420 of the Indian Penal Code .

3 . As per prosecution case , on the complaint made by the beneficiary an enquiry was conducted and these petitioners were found indulged in black-marketing of food grains.

4. Petitioner No. 1 is PDS dealer and petitioner No. 2 is working in the PDS shop of petitioner No. 1 . 5 . Learned counsel for petitioners denies the

No.46351 of 2024(4) dt.23-09-2024 2/2 prosecution case and submits that the alleged enquiry was conducted behind the back of the petitioner No. 1 and thereafter a show cause notice was isssued and petitioner No. 1 replied to the same and during pendency of the case , license of PDS shop of petitioner No. 1 has already been suspended. Petitioners claim clean antecedent.

6 Learned counsel for the State opposed the bail petition .

Considering the fact that license of PDS shop of petitioner No. 1 has already been suspended , clean antecedent of these petitioners and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XII Vaishali Hajipur in connection with Lalganj P.S. Case No. 07 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
