Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Rajauli P.S. Case No.302 of 2016 registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is that in course of checking of the vehicles, one Ambassador car bearing Registration No.BR01AS/3186 was searched and in course of search, 83 bottles, each containing 750 ml. Indian Made Foreign Liquor, were recovered from the dickey of the aforesaid Ambassador car. At that time, the

Patna High Court Cr.Misc. No.3111 of 2017 (3) dt.01-03-2017 2/2 petitioner was found sitting in the aforesaid Ambassador car, which was being driven by the co-accused Sharwan Kumar. Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal antecedent is in custody since 29.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S. Case No.302 of 2016.
