The petitioner apprehends her arrest in connection with Akilpur P.S. Case No. 36 of 2020 registered for the offences under Sections 304(B)/34 of the Indian Penal Code. As per the first information report, the husband of the deceased is alleged to have illicit relation with another lady and because of the same she was being tortured and finally she has been killed. Internal injury has been found on the body of the deceased. Illicit relation with the petitioner is one of the reasons behind death of the deceased.
Learned counsel for the petitioner has produced a copy of the order granting bail to the co-accused Rabita Devi who is said to have illicit relation with the husband of the
Patna High Court CR. MISC. No.36185 of 2020(4) dt.27-10-2021 2/2 deceased.
Learned counsel for the informant has produced before me a copy of the order dated 08.10.2020 passed in Cr. Misc. No. 12176 of 2020 by which anticipatory bail petition of co-accused Nandlal Mahato having similar allegation has been rejected considering the injuries sustained by the deceased. In the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail is hereby rejected.
