JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 10-03-2021 Supplementary affidavit filed by the petitioner, which is kept on record. In paragraph-3, the petitioner has got no any criminal antecedent, but now one criminal antecedent against the petitioner which is stated in supplementary affidavit. Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Bhagwanpur P.S. Case No. 277 of 2019 registered for the offence punishable under Section 394 of the Indian Penal Code. On the basis of the informant, the informant Md. Dildar Alam was going to Muzaffarpur from Apache Bike. Bike is of his brother. He reached near L.N. College, Bhagwanpur, P.S. Bhagwanpur were three miscreants on a motorcycle over took the informant and taken away key of vehicle and on point

No.37390 of 2020(4) dt.10-03-2021 2/2 of pistol, cash Rs.5,000/- and owner books snatched and try to snatched vehicle, which he fired from pistol and they hit on the knee of the informant and this way, the informant sustained injury that seeing the some people coming on road the miscreant fled away.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. No any incriminating article has been recovered from the conscious possession of the petitioner. No T.I. Parade has been held and the petitioner is in jail custody since 20.05.2020.

Learned A.P.P. for the State opposed the bail petition. Considering this fact that no T.I. Parade has been held till date, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st , Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 277 of 2019.
