JUSTICE SUDHIR SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 366, 366(A) and 34 of the Indian Penal Code.

The prosecution story, in brief, is that in the night of 12.4.2014, the daughter of the informant was traceless with ornaments worth Rs. 15,000/- and on 20.4.2014, the informant came to know that two boys kept hidden his daughter in a room on which when police was informed. A raid was conducted and victim was recovered as well as one accused Sunil Kumar was also apprehended, but his friend, namely, Chhotu Yadav, fled away from there and then informant returned home with his daughter where the victim stated that with the help of petitioner,

Patna High Court Cr.Misc. No.19054 of 2015 (3) dt.09-07-2015 2/2 she was kept hidden in the room and thereafter informant sent the victim to her brother's place at Madhya Pradesh but the accused persons including the petitioner started threatening and demanding rupees five lacs.

On behalf of the petitioner it has been submitted that the main allegation is against one Sunil Yadav with whom it is alleged that the daughter of the informant eloped. No specific allegation has been made against the petitioner. The only allegation is that the petitioner is relative of Sunil Yadav. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Buxar, in connection with Nawanagar ( Basudeva O.P.) P.S.Case No. 221 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U T
