====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 11-09-2019 Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Sabour P.S. Case No. 359 of 2018 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code to which section 302 IPC was added later on.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to admitted land dispute. There is nothing specific overt act alleged against this petitioner, rather the allegations are general and omnibus. During investigation,

No.35385 of 2019(4) dt.11-09-2019 2/2 independent witnesses have categorically stated only to the effect that when Ram Yadav (petitioner) tried to save Yogi Yadav, Bambam Mandal (deceased) cut him with his teeth, as would be evident from paragraphs 78-83 of the case diary. Petitioner is in custody since 25.12.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 359 of 2018.
