The petitioner seeks bail in a case instituted under Sections 394 of the Indian Penal Code.

The prosecution story, in brief, is that some unknown miscreants after pointing pistol on the informant, looted the cash counter of the petrol pump. The accused persons also assaulted the informant by fist and slaps. The accused persons also looted Icard, Intex mobile phone, Pan card, driving licence, Honour book of the motorcycle, Adhar card etc and thereafter fled away. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.05.2016. The charge sheet has been submitted in the present case. There is no allegation of

Patna High Court Cr.Misc. No.6894 of 2017 (2) dt.08-03-2017 2/2 tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. He has not been put on T.I.P. to ascertain his implication in the present case. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Mukesh Kumar Mishra, J.M.1st Class, Muzaffarpur, in connection with Motipur P.S. Case No. 61 of 2016.
