The petitioner has preferred this application for grant of regular bail in a case registered under section 379 of the Indian Penal Code.

As per the prosecution case, the informant who had parked his motorcycle and gone to purchase some article, on return found his motorcycle missing.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of a co-accused made before police. The petitioner was remanded in the instant case on 2.1.2021 and the cause of his false implication is his antecedents. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the materials on record together with the petitioner having remained in custody for more than 1 year 2 months, the Court directs the petitioner to be enlarged on bail in connection with Sahebganj P.S. Case no. 180 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-1, Muzaffarpur (West), Muzaffarpur.
