JUSTICE BIRENDRA KUMAR ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is languishing in custody for the offences punishable under Sections 363 and 364 of the Indian Penal Code. According to FIR, the petitioner is suspected to have kidnapped to the son of the informant. Statement of the victim boy under Section 164 Cr.P.C. reveals that he has voluntarily gone with the petitioner and on inducement of petitioner both were working as labourer in a hotel. On inducement of the petitioner, he had sold his cycle and mobile phone.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.9548 of 2017 (3) dt.02-05-2017 satisfaction of learned Judicial Magistrate, Kishanganj/Successor Court, in connection with Terhagachh P.S. Case No.53 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
