The petitioner is apprehending his arrest in connection with Jhajha P.S. Case No. 163 of 2014 registered under Sections 341, 323, 504 and 302/34 of the Indian Penal Code. In the First Information Report the informant claimed to be eye witness to the occurrence but he has not seen who assaulted his father and on what part of body and only saw that Binod Yadav, Ladu Yadav and Rajo Yadav came with Kudal and lathi and there was scuffle between his father and three accused persons and thereafter, his father fell down. However, post mortem report suggests no injury on the person of the deceased. Learned counsel for the petitioner submits that there is no

Having regard to the facts and circumstances of the case, the above named petitioner in the event of his arrest/surrender within a period of four weeks from today in the court below shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Shyamal Kumar, Judicial Magistrate, 1st Class, Jamui, in connection with Jhajha P.S. Case No. 163 of 2014, subject to condition as laid down under Section 438(2) of Cr.P.C. m.p.
