The petitioner is apprehending his arrest in connection with Parasbigha P.S. Case No. 17 of 2016 registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that there is land dispute between the parties from before and there is allegation against the petitioner of assault but the injuries on the person of injured are simple in nature.
Heard learned APP also.
Considering the fact that there is land dispute between the parties and the injuries are simple in nature, let the petitioner, named above, in the event of his arrest or surrender in the court
Patna High Court Cr.Misc. No.7237 of 2017 (2) dt.22-02-2017 2/2 within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri P.K.Bharti, Judicial Magistrate, 1st Class, Jehanabad, in connection with Parasbigha P.S. Case No. 17 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioner shall co-operate in the investigation and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of his bail bonds and further petitioner will not induce any witness or tamper with the evidence.
