Petitioner seeks bail in Alamnagar P.S. Case No. 173 of 2016 for the offences punishable under Sections 25(1-B)a, 26 of the Arms Act.

It has been submitted on behalf of the petitioner that the petitioner has been maliciously dragged in this case with false accusation merely on suspicion. Moreover, no incriminating article has been recovered from the possession of the petitioner and he is in custody since 21.01.2016. A statement has been made in paragraph no.3 that the petitioner has no criminal antecedent except one case i.e. Alamnagar P.S. Case No144 of 2016. Learned APP for the State opposes the prayer for

Considering the above facts and circumstances, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Udakishunganj at Madhepura, in connection with Alamnagar P.S. Case No. 173 of 2016.
