JUSTICE SANJAY PRIYA ORAL ORDER 2/ 25-06-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Patori P.S. Case No.356 of 2018 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code, Sections 25(1-b)a, 26 of the Arms Act and Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioner submits that petitioner is not named in the written report. Instant case is counter blast of Patori P.S. Case No.355 of 2018 lodged by brother of the petitioner against brother of the informant. Name of the petitioner has come during investigation merely on suspicion. In the written report, there is allegation against three
Patna High Court CR. MISC. No.37608 of 2019(2) dt.25-06-2019 2/2 accused persons, namely, Rudal Rai, Ajieet Kumar @ Mohan Ray and Anuj Kumar of causing assault.
Counsel for the petitioner submits that co-accused, Rudal Rai, has already been granted regular bail by co-ordinate Bench of this Court by order dated 13.02.2019 passed in Cr. Misc. No.6563 of 2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, IV, Samastipur, in connection with Patori P.S.
