This application for regular bail arises out of Riga P.S. Case No. 126 of 2020, disclosing offences punishable under Sections 25 (1-b) a/26/35 of the Arms Act.

The petitioner is in custody since 16.05.2020. It is alleged in the First Information Report that when the police attempted to intercept three persons, who were riding a motorcycle, they attempted to flee away. One of them (the petitioner) was apprehended, who disclosed names of two persons, who had managed to flee away. Allegedly, from the petitioner's possession one loaded country made pistol was recovered.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.35714 of 2020(2) dt.15-01-2021 2/2 has submitted that the petitioner has no criminal antecedent as stated in paragraph 3 of the application.

Considering the aforesaid submission and the fact that the petitioner is in custody since 16.05.2020, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Sitamarhi in Riga P.S. Case No. 126 of 2020.
