The Petitioner seeks bail in Tekari(Panchanpur) P.S. Case No. 224 of 2016 instituted for the offence under Section(s) 409 of the Indian Penal Code.
It is alleged that petitioner being Chairman of Dighaura PACS sold 888 quintals of paddy worth Rs. 12,52,880/- in the open market and misappropriated the money sanctioned for the financial year 2015-16.
It has been submitted on behalf of the petitioner that he has already deposited the entire amount along with interest total Rs. 14,11,090/- for the period 2015-16 for which no dues
Patna High Court Cr.Misc. No.8167 of 2017 (2) dt.09-03-2017 2/2 certificate has also been issued by the Branch Manager of Magadh Central Cooperative Bank, as annexed in Annexure-2 of the petition.
As such, as per Annexure-2, it appears that entire amount has already been paid by the petitioner and no dues certificate has also been issued by the bank to the petitioner. The petitioner is said to be in custody since 18.01.2017.
In the facts and circumstances of the case, the prayer of the petitioner for bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 6th, Gaya in connection with Tekari(Panchanpur) P.S. Case No. 224 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
