2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Bidupur P.S. Case No. 144 of 2023 registered on 07.03.2023 lodged under Sections 399, 402, 413, 414, 467, 468, 471, 120(B) of the Indian Penal Code and Section 25(1-b)a, 26, 35 Arms Act.

4. As per the prosecution case, F.I.R. has been lodged against 11 named accused persons about which in the F.I.R. it has come that all the accused persons were planing of dacoity and upon secret information raid was conducted by the police and they were arrested. He submits that Rs. 4,300/- has been recovered from the possession of the petitioner.

5. Counsel for the petitioner submits that arms etc.

Patna High Court CR. MISC. No. 39511 of 2023(2) dt.07-07-2023 2/2 have also been recovered from the possession of other persons.

6. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 08.03.2023 having one criminal case pending against him, but after the present case he was remanded in the said case. Counsel submits that charge-sheet has already been submitted in this case.

7. Learned counsel for the State opposes the prayer for bail.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Bidupur P.S. Case No. 144 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

9. With this observation, the bail application stands allowed.
